After-Sales and Lease Services
After-sales and lease services must be included in the original contract or extended sales agreement, lease or rental agreement, warranty, or service contract. These services must be performed by an Original Equipment Manufacturer (OEM), an employee of the OEM, or a third party identified in the original sale agreement for that purpose.
Provided it is included in the original sales agreement or extended warranty, the foreign national can install, set up, and test commercial equipment, machinery, or software if such work requires proprietary or product-specific knowledge. They can also train or supervise Canadian workers on the commercial equipment, machinery, and software, and supervise installers.
Additionally, they can repair and service the equipment, machinery, or software, and perform software upgrades. However, some activities cannot be performed in Canada by a business person, even if stipulated in the agreement. These include operating the equipment, machinery, or software for production and hands-on installation activities typically performed by construction or building trades.
